 EXCLUSIVE BUYER AGENCY AGREEMENT

 

This is a legally binding contract.  If not understood, seek legal advice.

 

1. The undersigned........................................................................ ("Buyer") hereby retains Chuck Bahner, Real Estate Broker - Busy Bee Realty LLC (Broker) for the purpose of exclusively assisting BUYER to procure property of a nature outlined below or other property acceptable to buyer, and to negotiate terms and conditions acceptable to BUYER for purchase or exchange of such property.

 

By appointing Broker as BUYER'S exclusive agent, BUYER agrees to conduct all negotiations for property of the type described in Section 2 hereof through Broker, and to refer to Broker all inquiries received in any form from real estate Brokers, salespersons, prospective sellers, or any other source during the time of this agency contract is in effect.  In addition, BUYER agrees that any Broker compensation which is conditioned upon the acquisition by BUYER of interests in real property whether by lease or purchase, will be earned by Broker whenever such interests in real property are acquired by BUYER, or by BUYER through any person or entity, without any discount or allowance for any efforts made by BUYER or by any other agent of BUYER in connection with the acquisition of such interests in real property by BUYER.

 

This contract shall commence this date and terminate at midnight on ............................, 20..............

 

2.  General Nature, Location and Requirement of Property:  In State of Kentucky - Residence.

 

3.  Compensation:  If BUYER purchases or leases real property which Broker has interacted with BUYER through either showing, email, electronic, telephonic or Internet means during the term of this agreement, BUYER authorizes Chuck Bahner, MBA, Real Estate Broker - Busy Bee Realty LLC (Broker) to receive and/or negotiate a commission to be paid by the SELLER or the SELLER'S Agent.  Such commission could be advertised on a MLS sheet or separately negotiated.

 

4.  Termination by Buyer:  Subject to the provisions of Section 3 entitled Compensation, in the event of termination by BUYER prior to completion of the purpose of this agency, and prior to the termination date set forth in Section 1.  Broker shall be entitled to reimbursement by BUYER for all expenditures reasonably incurred by Broker pursuant to this agency contract. 

 

5.  Agency Relationships:  Broker represents and BUYER acknowledges that Broker exclusively represents BUYER, unless BUYER views, receives information about, or negotiates for properties listed by Broker.  In that case, BUYER agrees that Broker may represent both Buyer and Seller as a disclosed dual agent, and shall execute a disclosure form and an agreement or dual agency.

 

6.  Information and Availability:  BUYER shall reasonably cooperate with Broker regarding financial and personal information.

 

7.  Sole Contract:  The parties agree that this contract constitutes their entire contract and that no oral or implied contract exists.  BUYER acknowledges BUYER has not entered into a BUYER Broker Contract with any other real estate company.  BUYER acknowledges Broker's advice to seek legal counsel, that he/she has read this contract, the information contained herein is true and accurate to the best of his/her knowledge and that he/she received a copy of this contract in it's completed form on ..........................................................,20..............................
